Specific Webemus GroupJoom Terms & Conditions

The acceptance of this agreement leads to the acceptance of the Terms and Conditions of Webemus as well as the Privacy Policy and the Refund Policy published on our website

  • The Product acquisition of Webemus GroupJoom entitles the use of it in a single domain or website, being a permanent license in the mode of purchase and limited (to the length of rental) for rent mode.
  • The client acquires the right of use of the product but not the property of the source code.
  • You can not transfer the right to use the product Webemus GroupJoom to another company or person without the consent of Webemus. If we detect this situation we will proceed to remove the license and the right of use.
  • To prevent fraudulent copy of the product Webemus GroupJoom, a little part of the product code is encrypted, however, it is mostly open source that can be modify if required.
  • Webemus GroupJoom product can be modified overwriting the output templates using the on-write mechanism that Joomla provides and recommends; the same applies to style guides, client images and language. Any other change made by the customer directly in the application files without using the Joomla mechanism, will not be supported by Webemus and will be lost in case of future product updates of Webemus GroupJoom.
  • Webemus works with Joomla content manager that due of its great popularity has a lot of components; many are free, allowing several important features at low cost. Webemus GroupJoom use, for example, AcyMailing component for subscription to newsletters and contact list management, and EasyBlog to create the blogs for the websites. It requires the customer to suit the standard features of these components. The standard functioning of the components can not always be a 100% as could be required by the customer at it should be assumed. These components require keeping the software updated for proper operation.
  • For all “ready to open” packages where the web customization is included, the design used to create the website will be supplied by the customer, it is not included in any of the Webemus GroupJoom contracting packages. If the design supplied by the customer is based on the standard product layout, Webemus will make the changes as "standard design" but if the design change much in relation to the default product layout, it will be considered an exclusive design and the necessary changes will be made on the web within the "Exclusive Design" package.
  • For all “ready to open” packages, the images and the contents used in the creation of the website will be supplied by the customer. Texts and images that come with the Webemus GroupJoom standard product that is install are examples for the customer.
  • Webemus puts all its effort into the free processing errors programming, but in case of faults or errors were reported in the same, they must be reported by the customer through the Webemus support system and will be corrected as soon as possible, depending on its severity. The client expressly disclaims Webemus claim any contractual or extra-contractual liability for any errors, mistakes and use of the service. Such errors will be corrected free of charge within the Support Service that the customer must have up to date by extending the same after its expiration.
  • Old versions of Webemus GroupJoom are not supported. New versions are officially published in the blog of Webemus. Webemus only supports the current version and the previous version of the product Webemus GroupJoom.
  • For packages that includes adapting and configuring the website by Webemus, the client will have access to the website, using the domain name and a private access. The website will be closed to the public while Webemus is working on it; once it is finished, customer is satisfied with the web and approved it and made full payment of the project, it will be open to the public.
  • The times for delivery the web, depend on the complexity of the web and the workload we have at the moment, may be between 5 and 15 working days depending on the type of web and if we have all the necessary information from customer (texts, design, payment gateway data, etc.).   • Webemus offers several packages of Technical Support Service by hours that can be subscribed by the customer in packs of hours that can be used to do additional changes to the website (not included in the initial project) or to do additional functionality changes as well.
  • Webemus does not support all versions of internet browsers; these are the minimum browser versions supported: Internet Explorer 10, Firefox 3.6, Safari 4 and Google Chrome 10. For other browsers and versions, the customer must consult before hiring the service.
  • Webemus is not responsible for the fraudulent use of the web by malicious users or attacks by computer hackers or pirates. In case there is a security hole in the Webemus GroupJoom product, it will be solved by Webemus within the Support Service.
  • Webemus GroupJoom product is sold "as it is in the demo site" with functions and characteristics specified on the Webemus website and which you can see and test in the demo of the product. Any claim made by the customer about a feature or characteristic "not present" or it "doesn't work as expected" or that it doesn't work as in other similar product, it will be not taken into consideration and Webemus is not responsible for these claims. The customer may request the development of function or characteristic desired to Webemus who will determine if it is possible and the cost of its development.
  • All Webemus GroupJoom “ready to open” packages includes changing of colors and logo for the mobile version of the default product (standard), any other modification of the mobile version of the standard product required by the customer will be valued separately with an additional cost .
  • The customer should give to Webemus access to the payment platform to perform the adaptation of it to the website. Webemus agree to use these data solely for this use. Customer is required to change passwords tpv control panel once the configuration of the website is done. Webemus is not responsible for any fraudulent or misuse of the payment platform.
  • The current fees for products and services are shown on our web webemus.com
  • The prices shown on our website webemus.com excluding VAT except those explicitly indicated with the text "+ VAT".
  • Webemus does not allows the elimination of Webemus brand, or delete the News panel "Webemus latest news GroupJoom" or changes on the component name “Webemus GroupJoom” in the web administration.
  • The Webemus GroupJoom product updates with improvements and fixes in new versions can be automatic or could in some cases requires additional steps that the customer can make on their own; it may also requires technical knowledge in Joomla. The cost of upgrades installations of the product by Webemus, will be done through the subscription of units of hours of Technical Service depending on current rate, discounted in units of credit/minute (1 minute = 1 credit). Webemus will try to make these updates the most automatic possible. Product updates are done manually and it is only applicable if the customer has an up-to-date Support Service for the product.
  • An external service of smtp client should be hire is required for sending newsletters emails. We are currently working with ElasticEmail smtp provider, this external smtp service has a cost that must be pay for the customer.

Fix initial payment for the configuration and adaptation of the web site by Webemus and a fix monthly payment to use the product and receive Technical Support Service.

Include:

  • Temporary license for 1 website(domain), technical support and right to the product updates released during the rental.
  • The rent of the web starts counting from the first day of the installation of the Webemus GroupJoom product  at the customer's hosting account. The web will have a temporary license of 31 days, it must renewed before expiration.

Webemus GroupJoom mobile applications for Android and iPhone

Mobile app personalized with the design of your website with all the necessary functionality for users to buy, see offers and manage coupons from their  mobile phone. Business user accounts used by merchants can also use the mobile app with all the features to validate coupons using QR code between other many functions.

Includes:
  • Publication of the website application in the Google Play and Apple Store  using the customer account* (Icons creation, images generation, description of the application, etc.)
  • Includes the creation of one article and one banner in the website to show information of the mobile applications for the customers that want to install them.
  • It does not include changes to features and design of the app. They are supplied with the necessary functionality and design compatible with the client's website.
  • Support to mobile apps are included in the Webemus GroupJoom product support service. Customer should be subscribed to the Support Service and it should be updated.

Requires:

  • Requires developer Google Play account previously created by the customer with a cost, paid to Google.
  • Requires developer account  in the Apple Store previously created by the customer with a cost paid to Apple.
  • Requires in onesignal account previously created by the customer to be able to send notifications push to mobile platforms.

Support Service

  • The Support Service includes answers to questions about Webemus GroupJoom product, solution to errors reported by the customer and right to get product upgrades or new versions of the product that are released.
  • Customer should extend the Support Service for the product Webemus GroupJoom once it is expired. In this way the customer will always have the website updated with the latest changes and product upgrades and you will have access to ticket query system and solving problems and questions with the product.
  • The Support Service will be provided only through the Webemus intranet ticket system. The customer can access to this system of tickets in the web of Webemus using his account user and password.
  • In any case post-sales support  can be done through other means than the ticket system, specifically consultations cannot be made using Email, phone calls, Whatsapp, Skype, etc.
  • Priority Support: At Webemus, our commitment is to offer our customers excellent support and rapid response. However, we know that some of our customers need to move more quickly than others. So you can receive the fastest possible response and the highest level of technical support at all times, we offer the possibility of hiring a Priority Support Service.
  • There are three sections in the Support System:
    • Queries and reporting of errors: this section is free and public.
    • Requests for technical service and private consultations: this section is private and involves the cost of one (1) credit to create a new ticket.
    • Priority Support: This section for questions or reporting of incidents is only available to customers that hire priority support, free and private.
  • The response time for incidents and consultations:
    • Standard Support: 3 working days
    • Support priority: 1 working day.
  • The response time to requests technician service:
    • Standard Support: 3 working days for small requests that requiere less than 60 minutes/credits of technical development. For larger requirements it will depend on our availability planned by calendar.
    • Priority Support: 1 working day for for small requests that requiere less than 60 minutes/credits of technical development. For larger requirements it will depend on our availability planned by calendar.
  • Extension of the support service
    • Once initial Support period included in the package contracted is expired, customer should extend the service.
    • The extension of the Support Service can be made for periods of 1, 3, 6 and 12 months.
    • The extension of the Support Service should be extended Max 10 days after the date of expiration of the previous Support expiration date.
    • Extension period always starts from the day after the expiration of the previous Support.
    • After those 10 days customer loses the right to extend Support leaving the website without any kind of coverage to failures, errors or any other kind problems by Webemus.

Custom Developments

The customer can request to Webemus new developments or extension of the product functionality to adapt it to what he needs.

Developments requested and paid by customers could be incorporated into the standard product for the benefit of all Webemus GroupJoom users and to facilitate future updates.

Webemus does not offer exclusivity for these kind of developments.
